The Supreme Court made a significant observation during a hearing related to reservation policies, raising fresh questions around the concept of the creamy layer and social equality. The court discussed whether families that have already achieved strong economic and educational progress through reservation benefits should continue receiving the same advantages for the next generation. The remarks have once again brought the debate over the purpose and limits of reservation into national focus.
During the hearing, Justice BV Nagarathna said, “Students' parents are in good jobs, earning good salaries, but still the children want reservation. Look, they should come out of reservation.” She further questioned, “If both parents are IAS officers, why should there be reservation?” The court emphasized the need to maintain a balance between social justice and the changing realities of economically advanced families.
The discussion was linked to issues surrounding the creamy layer criteria in OBC reservation and whether financially and socially progressed families should remain eligible for quota benefits. The court indicated that reservation was introduced to support social upliftment and equal opportunity, not to become a permanent privilege across generations.
The Supreme Court’s remarks have now triggered widespread reactions across legal, political and social circles.
